Terminology Used

“Personal data” means all information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
“Processing” means any operation or set of operations which is performed on personal data, whether or not by automated means. The term is broad and encompasses practically every handling of data.

“Pseudonymisation” means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

“Profiling” means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

“Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

“Processor” means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Applicable Legal Bases

In accordance with Art. 13 GDPR, we inform you of the legal bases for our data processing activities. Where the legal basis is not specified in this privacy policy, the following applies: The legal basis for obtaining consent is Art. 6(1)(a) and Art. 7 GDPR; the legal basis for processing necessary for the performance of our services and the implementation of contractual measures, as well as for responding to enquiries, is Art. 6(1)(b) GDPR; the legal basis for processing necessary for compliance with our legal obligations is Art. 6(1)(c) GDPR; and the legal basis for processing necessary for the purposes of our legitimate interests is Art. 6(1)(f) GDPR. In cases where vital interests of the data subject or another natural person make the processing of personal data necessary, Art. 6(1)(d) GDPR serves as the legal basis.

Security Measures

In accordance with Art. 32 GDPR, taking into account the state of the art, implementation costs, and the nature, scope, circumstances and purposes of processing, as well as the varying likelihood and severity of risks to the rights and freedoms of natural persons, we implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk.

These measures include in particular safeguarding the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access, input, disclosure, assurance of availability and separation thereof. Furthermore, we have established procedures that ensure the exercise of data subject rights, the deletion of data, and responses to threats to data security. Moreover, we consider the protection of personal data already during the development or selection of hardware, software and procedures, in accordance with the principle of data protection by design and by default (Art. 25 GDPR).

Cooperation with Processors and Third Parties

If, in the course of our processing activities, we disclose data to other persons and companies (processors or third parties), transmit it to them, or otherwise grant them access to the data, this is done only on the basis of a statutory permission (e.g. if the transmission of data to third parties, such as payment service providers, is necessary for the performance of a contract pursuant to Art. 6(1)(b) GDPR), you have consented, a legal obligation provides for this, or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).

If we commission third parties to process data on the basis of a so-called “Data Processing Agreement”, this is done on the basis of Art. 28 GDPR.

Transfers to Third Countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this occurs in the context of using third-party services or disclosing, or transmitting, data to third parties, this is done only if it is necessary for the fulfilment of our (pre-)contractual obligations, on the basis of your consent, due to a legal obligation, or on the basis of our legitimate interests. Subject to statutory or contractual permissions, we process or have data processed in a third country only if the special conditions of Art. 44 et seq. GDPR are met. This means that processing takes place, for example, on the basis of special guarantees, such as the officially recognised determination of an EU-equivalent level of data protection (e.g. for the USA by the “Privacy Shield”) or compliance with officially recognised special contractual obligations (so-called “Standard Contractual Clauses”).

Rights of Data Subjects

You have the right to request confirmation as to whether or not personal data concerning you are being processed, and for information about such personal data and a copy of the data in accordance with Art. 15 GDPR.

In accordance with Art. 16 GDPR, you have the right to request that incomplete personal data concerning you be completed or that inaccurate personal data concerning you be rectified.

In accordance with Art. 17 GDPR, you have the right to demand that personal data concerning you be erased without delay, or alternatively, in accordance with Art. 18 GDPR, to request restriction of processing.

In accordance with Art. 20 GDPR, you have the right to receive the personal data concerning you which you have provided to us and to demand that such data be transmitted to another controller.

Furthermore, in accordance with Art. 77 GDPR, you have the right to lodge a complaint with the competent supervisory authority.

You have the right to revoke consent given in accordance with Art. 7(3) GDPR with effect for the future.

Right of Objection

In accordance with Art. 21 GDPR, you may at any time object to the future processing of personal data concerning you. The objection may in particular be made against processing for the purposes of direct marketing.

Cookies and Right of Objection Regarding Direct Marketing

“Cookies” are small files stored on users’ computers. Various data can be stored within cookies. A cookie primarily serves to store information about a user (or the device on which the cookie is stored) during or after their visit to an online service. Temporary cookies, also known as “session cookies” or “transient cookies”, are cookies that are deleted after a user leaves an online service and closes their browser. Such a cookie may, for example, store the contents of a shopping cart in an online shop or a login status. “Permanent” or “persistent” cookies are cookies that remain stored even after the browser is closed. For instance, the login status can be saved if users return to the site after several days. Similarly, such a cookie may store user interests used for reach measurement or marketing purposes. “Third-party cookies” are cookies offered by providers other than the controller operating the online service (otherwise, if only its own cookies are involved, they are referred to as “first-party cookies”).

We may use temporary and permanent cookies and explain this in our Privacy Policy.

If users do not wish for cookies to be stored on their computer, they are requested to deactivate the corresponding option in their browser’s system settings. Stored cookies can be deleted in the browser’s system settings. Excluding cookies may result in functional limitations of this online service.

A general objection to the use of cookies deployed for online marketing purposes, particularly in the case of tracking, can be declared via the US website http://www.aboutads.info/choices/ or the EU website http://www.youronlinechoices.com/ . Furthermore, cookie storage can be prevented by disabling cookies in the browser settings. Please note that this may prevent you from using all functions of this online service.

Erasure of Data

The data processed by us is erased or its processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated otherwise within this Privacy Policy, the data stored by us is erased as soon as it is no longer required for its intended purpose and there are no statutory retention obligations that preclude erasure. If the data is not erased because it is required for other legally permissible purposes, its processing is restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.

In accordance with statutory requirements in Germany, retention occurs in particular for 10 years pursuant to Sections 147(1) AO, 257(1) No. 1 and 4, (4) HGB (books, records, management reports, booking vouchers, commercial books, documents relevant for taxation, etc.) and for 6 years pursuant to Section 257(1) No. 2 and 3, (4) HGB (commercial letters).

In accordance with statutory requirements in Austria, retention occurs in particular for 7 years pursuant to Section 132(1) BAO (accounting records, receipts/invoices, accounts, vouchers, business documents, statement of income and expenses, etc.), for 22 years in connection with real property, and for 10 years for documents relating to electronically supplied services, telecommunications, broadcasting and television services provided to non-entrepreneurs in EU Member States for which the Mini One Stop Shop (MOSS) is used.

Contractual Services

We process the data of our contractual partners and interested parties as well as other clients, customers, mandates, clients or contractual partners (collectively referred to as “contractual partners”) in accordance with Art. 6(1)(b) GDPR, in order to provide them with our contractual or pre-contractual services. The data processed herein, the type, scope, purpose and necessity of their processing are determined by the underlying contractual relationship.

The data processed includes the master data of our contractual partners (e.g., names and addresses), contact details (e.g. email addresses and telephone numbers) as well as contract data (e.g., services utilised, contract content, contractual communication, names of contact persons) and payment data (e.g., bank details, payment history).

We do not generally process special categories of personal data, unless these are components of an entrusted or contractually agreed processing.

We process data that is necessary for the establishment and fulfilment of contractual services and point out the necessity of their provision, insofar as this is not evident to the contractual partners. Disclosure to external persons or companies only occurs if it is necessary within the framework of a contract. When processing data entrusted to us within the framework of an order, we act in accordance with the instructions of the clients as well as statutory provisions.

Within the scope of using our online services, we may store the IP address and the time of the respective user action. The storage is based on our legitimate interests, as well as the users' interests in protection against misuse and other unauthorised use. In principle, these data are not passed on to third parties, unless this is necessary for the pursuit of our claims pursuant to Art. 6(1)(f) GDPR or there is a statutory obligation to do so pursuant to Art. 6(1)(c) GDPR.

The deletion of data occurs when the data are no longer necessary for the fulfilment of contractual or statutory duties of care as well as for dealing with any warranty and comparable obligations, whereby the necessity of retaining the data is reviewed every three years; otherwise, the statutory retention periods apply.

Administration, Financial Accounting, Office Organisation, Contact Management

We process data within the scope of administrative tasks, the organisation of our business operations, financial accounting and compliance with statutory obligations, such as archiving. In doing so, we process the same data that we process in the context of providing our contractual services. The legal bases for processing are Art. 6(1)(c) GDPR and Art. 6(1)(f) GDPR. Those affected by this processing are customers, prospects, business partners and website visitors. The purpose and our interest in processing lies in administration, financial accounting, office organisation, archiving of data, i.e. tasks that serve to maintain our business activities, perform our duties and provide our services. The deletion of data with regard to contractual services and contractual communication corresponds to the information provided in relation to these processing activities.

In this context, we disclose or transmit data to tax authorities, advisors such as tax consultants or auditors, as well as other fee collection agencies and payment service providers.

Furthermore, based on our business interests, we store details regarding suppliers, event organisers and other business partners, for example for the purpose of future contact. These predominantly company-related data are generally stored permanently.

Contact

When contacting us (e.g. via contact form, e-mail, telephone or social media), the user's data are processed for the purpose of handling and processing the contact request in accordance with Art. 6(1)(b) GDPR (within contractual/pre-contractual relationships) and Art. 6(1)(f) GDPR (other requests). The user's data may be stored in a Customer Relationship Management system ("CRM system") or comparable enquiry organisation.

We delete enquiries once they are no longer necessary. We review the necessity every two years; furthermore, statutory archiving obligations apply.

Integration of Third-Party Services and Content

Within our online offering, we use content or service offers from third-party providers on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6(1)(f) GDPR) in order to embed their content and services, such as videos or fonts (hereinafter uniformly referred to as “Content”).

This always requires that the third-party providers of this Content perceive the IP address of the users, since without the IP address they could not send the content to their browser. The IP address is therefore necessary for the display of this Content. We endeavour to use only such content whose respective providers use the IP address solely for the delivery of the content. Third-party providers may also use so-called pixel tags (invisible graphics, also referred to as "Web Beacons") for statistical or marketing purposes. Through "Pixel Tags", information such as visitor traffic on the pages of this website can be evaluated. The pseudonymous information may also be stored in cookies on the user's device and may contain, inter alia, technical information about the browser and operating system, referring websites, visit time and other details regarding the use of our online offering, as well as be linked with such information from other sources.

Google Fonts

We embed the fonts ("Google Fonts") of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Privacy Policy: https://www.google.com/policies/privacy/, Opt-Out: https://adssettings.google.com/authenticated.

Google Maps

We embed the maps of the service “Google Maps” by the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The data processed may include in particular users’ IP addresses and location data, which are not collected without their consent (normally carried out within the settings of their mobile devices). The data may be processed in the USA. Privacy Policy: https://www.google.com/policies/privacy/, Opt-Out: https://adssettings.google.com/authenticated.

Temporary cookies, also known as “session cookies” or “transient cookies”, are cookies that are deleted after a user leaves an online offering and closes their browser. Such a cookie may, for example, store the contents of a shopping cart in an online shop or a login status. “Permanent” or “persistent” cookies are those that remain stored even after the browser is closed. If users do not wish for cookies to be stored on their computer, they are requested to disable the corresponding option in the system settings of their browser. Stored cookies can be deleted in the browser’s system settings. Excluding cookies may lead to functional limitations of this online offering.

A general objection to the use of cookies deployed for online marketing purposes, particularly in the case of tracking, can be declared via the US website http://www.aboutads.info/choices/ or the EU website http://www.youronlinechoices.com/ . Furthermore, the storage of cookies can be prevented by disabling them in the browser settings. Please note that this may result in not all functions of this online offering being available.

Erasure of Data

The data processed by us is erased or its processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated otherwise within this Privacy Policy, the data stored with us will be erased as soon as it is no longer necessary for its intended purpose and there are no statutory retention obligations preventing erasure. If the data is not erased because it is required for other legally permissible purposes, its processing will be restricted. This means that the data will be blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons.

In accordance with statutory requirements in Germany, retention occurs in particular for 10 years pursuant to Sections 147(1) AO, 257(1) No. 1 and 4, (4) HGB (books, records, management reports, accounting vouchers, commercial books, documents relevant for taxation, etc.) and for 6 years pursuant to Section 257(1) No. 2 and 3, (4) HGB (business letters).

In accordance with statutory requirements in Austria, retention occurs in particular for 7 years pursuant to Section 132(1) BAO (accounting records, receipts/invoices, accounts, vouchers, business documents, statement of income and expenditure, etc.), for 22 years in connection with real property, and for 10 years for documents relating to electronically supplied services, telecommunications, broadcasting and television services provided to non-entrepreneurs in EU Member States for which the Mini One-Stop Shop (MOSS) is used.

Google Analytics

We use Google Analytics, a web analysis service provided by Google LLC (“Google”), on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6(1)(f) GDPR). Google uses cookies. The information generated by the cookie regarding use of the online offering by users is generally transmitted to a Google server in the USA and stored there.

Google is certified under the Privacy Shield Agreement and thereby provides a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate the use of our online offering by users, to compile reports on activities within this online offering and to provide us with other services related to the use of this online offering and internet usage. Pseudonymous user profiles may be created from the data processed.

We use Google Analytics only with IP anonymisation activated. This means that the user’s IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

The IP address transmitted by the user’s browser is not merged with other data from Google. Users can prevent the storage of cookies by a corresponding setting of their browser software; users can also prevent the collection of data generated by the cookie and related to their use of the online offering by Google as well as the processing of this data by Google by downloading and installing the browser plugin available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

Further information on data usage by Google, settings and objection options can be found in Google’s privacy policy (https://policies.google.com/technologies/ads) as well as in the settings for the display of advertisements by Google (https://adssettings.google.com/authenticated).

The personal data of users are deleted or anonymised after 14 months.

Google AdWords and Conversion Tracking

On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6(1)(f) GDPR), we use the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, (“Google”).

Google is certified under the Privacy Shield Agreement and thus provides a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

We use the online marketing method Google "AdWords" to place ads in the Google advertising network (e.g. in search results, in videos, on websites, etc.) so that they are displayed to users who have a presumed interest in the ads. This allows us to display ads for and within our online offering in a more targeted manner, in order to present users only with ads that potentially correspond to their interests. If, for example, ads for products are displayed to a user for which he has shown interest on other online offerings, this is referred to as “Remarketing”. For these purposes, when our websites and other websites on which the Google advertising network is active are called up, a code from Google is executed directly by Google and so-called (Re)marketing tags (invisible graphics or code, also referred to as "Web Beacons") are integrated into the website. With their help, an individual cookie, i.e. a small file, is saved on the user's device (instead of cookies, comparable technologies can also be used). This file records which websites the user has visited, for which content he is interested and which offers the user has clicked on, as well as technical information about the browser and operating system, referring websites, visit time and further details regarding the use of the online offering.

Furthermore, we receive an individual “Conversion Cookie”. The information obtained with the help of the cookie serves Google to create conversion statistics for us. However, we only learn the anonymous total number of users who have clicked on our ad and were redirected to a page equipped with a Conversion Tracking Tag. However, we do not receive any information that allows users to be personally identified.

The user's data is processed pseudonymously within the framework of the Google advertising network. This means that Google does not store and process, for example, the name or email address of the user, but processes the relevant data cookie-related within pseudonymous user profiles. This means that from Google's perspective, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who this cookie holder is. This does not apply if a user has expressly allowed Google to process the data without this pseudonymisation. The information collected about users is transmitted to Google and stored on Google's servers in the USA.

Further information on data usage by Google, settings and objection options can be found in Google's privacy policy (https://policies.google.com/technologies/ads) as well as in the settings for the display of advertising insertions by Google (https://adssettings.google.com/authenticated).
